This document contains the Terms of Service and Privacy Policy of Ticino Treks and Expeditions Pvt. Ltd. “Ticino Treks,” “Company,” “we,” “our,” or “us” refers to Ticino Treks and Expeditions Pvt. Ltd., an esteemed travel, trekking, expedition, and tour company based in Nepal. “Client,” “traveller,” “participant,” “you,” or “your” refers to any person who accesses our website, communicates with us, makes an inquiry, books a service, participates in a trip, or uses our services.
By accessing our website, submitting an inquiry, making a booking, paying a deposit, or participating in any trek, expedition, tour, or related service arranged by Ticino Treks, you confirm that you have read, understood, and agreed to this document.
This document is intended to provide transparent commercial, safety, payment, cancellation, and privacy terms for international and domestic clients.
Part A: Terms of Service
1. Scope of Services
Ticino Treks provides travel, trekking, expedition, tour, adventure, cultural, nature, and related travel arrangement services in Nepal and, where applicable, neighbouring destinations or international regions. Our services may include, but are not limited to:
- Trekking packages;
- Expedition and mountaineering packages;
- Cultural, heritage, spiritual, and nature tours;
- Private, group, tailor-made, and fixed-departure trips;
- Hotel, lodge, teahouse, camp, and accommodation coordination;
- Domestic transportation and airport transfers;
- Guide, porter, crew, cook, and support staff arrangements;
- Permit, conservation area, national park, restricted area, and climbing documentation assistance;
- Equipment, logistics, meals, and ground operation coordination where stated in the itinerary;
- Emergency coordination, evacuation assistance, and rescue support where reasonably possible.
The exact inclusions and exclusions for each package will be stated in the relevant itinerary, proposal, invoice, booking confirmation, or written communication from Ticino Treks.
2. Eligibility and Client Responsibility
By booking with us, you confirm that:

You are at least 18 years old or are booking through a parent, guardian, or authorized representative.

You have the legal capacity to enter into this agreement.

All information you provide to us is accurate, complete, and not misleading.

You understand that trekking, expedition, mountaineering, high-altitude travel, remote-area travel, and adventure tourism involve inherent risks.

You are responsible for assessing whether a trip is suitable for your physical condition, medical condition, skill level, experience, and risk tolerance.

You will comply with all safety instructions, local laws, conservation rules, permit conditions, cultural norms, and guidance from our guides, leaders, and representatives.
We reserve the right to refuse service, remove a participant from a trip, or decline a booking if we reasonably believe that the person may create safety risks, legal risks, operational risks, or disruption to the group.
3. Adventure Travel and Assumption of Risk
Our services may involve travel in remote mountain regions, high-altitude areas, wilderness environments, rural communities, and locations where infrastructure, medical facilities, communications, roads, and rescue services may be limited or unavailable.
Risks may include, but are not limited to:
- Altitude sickness, Acute Mountain Sickness, HAPE, HACE, dehydration, hypothermia, frostbite, sun exposure, fatigue, injury, illness, or death;
- Landslides, avalanches, rockfall, glacier hazards, crevasses, river crossings, snow, ice, storms, earthquakes, floods, wildfire, or other natural hazards;
- Flight delays, road blockages, vehicle breakdowns, strikes, political events, permit delays, border restrictions, weather disruptions, or changes in government rules;
- Limited access to hospitals, rescue, helicopter evacuation, telecommunications, electricity, internet, banking, or modern facilities;
- Risks associated with animals, local transport, shared accommodation, food, sanitation, and third-party services;
- Changes in itinerary caused by safety, weather, health, logistics, permits, or operational conditions.
By booking with us, you voluntarily accept these risks. Ticino Treks will take reasonable care in arranging services, selecting staff, designing itineraries, and responding to emergencies, but we cannot eliminate all risks associated with adventure travel.
4. Booking Process
A booking is considered confirmed only when:

We have received the required deposit or full payment;

We have issued written booking confirmation by email, invoice, receipt, or official communication;

Required traveller details have been submitted, including passport details, emergency contact information, insurance details, and any required medical or dietary information.
Quotes, itineraries, and availability shared before confirmation are subject to change without notice. Prices, permits, flights, accommodation, and services may not be guaranteed until the booking is confirmed.
5. Deposits and Payment Policy
Unless otherwise stated in the relevant package or invoice:

A deposit is required to secure a booking.

The deposit amount may vary depending on the nature of the trip, permit requirements, hotel bookings, flight bookings, logistics, and supplier conditions.

The remaining balance must be paid by the due date stated in the invoice or booking confirmation.

For last-minute bookings, full payment may be required at the time of booking.
-
For expeditions, restricted-area treks, peak climbing, helicopter services, luxury arrangements, or customized tours, higher deposits or full prepayment may be required due to non-refundable supplier commitments.
Payments may be accepted through bank transfer, online payment gateway, card payment, cash, or other approved payment methods. Any bank fees, wire transfer charges, card processing fees, currency conversion charges, intermediary bank fees, or payment gateway charges are the responsibility of the client unless otherwise agreed in writing.
6. Currency, Taxes, and Exchange Rates
Prices may be quoted in USD, EUR, GBP, NPR, or another currency, depending on the client and package. Final payment currency and exchange rate treatment will be stated in the invoice or booking confirmation.
Where payment is made in a different currency from the quoted price, the payable amount may be adjusted based on applicable exchange rates, bank rates, or payment gateway rates. Ticino Treks is not responsible for losses or additional costs caused by exchange rate fluctuations, bank conversion rates, foreign transaction fees, or charges applied by the client’s bank or card provider.
All applicable taxes, government fees, permit fees, service charges, and statutory charges may be added where required unless the itinerary expressly states that they are included.
7. Price Changes and Surcharges
We make reasonable efforts to maintain quoted prices. However, prices may change due to circumstances beyond our control, including but not limited to:

Government tax, royalty, permit, conservation, park, or climbing fee changes;

Fuel price increases;
-
Domestic or international flight price changes;
-
Currency fluctuations;
-
Supplier rate changes;
-
Accommodation rate changes;
-
Changes in route, itinerary, transport, or logistics due to weather, safety, government order, or other contingencies;
-
Additional services requested by the client.
Once a booking is confirmed, we will not change the base package price except where the change results from government fees, taxes, fuel surcharges, exchange rate fluctuation, third-party supplier increases, force majeure, or client-requested changes.
8. Client Cancellation Policy
All cancellation requests must be submitted in writing by email. The cancellation date will be the date on which Ticino Treks receives the written cancellation request.
Unless a specific package has a different cancellation policy, the following standard policy applies:

More than 60 days before trip start date: Deposit may be partially refundable after deducting administrative costs, bank charges, permit fees, supplier charges, and non-refundable expenses already incurred.

30 to 60 days before trip start date: A cancellation charge may apply, and part or all of the deposit may be non-refundable.
-
15 to 29 days before trip start date: A significant cancellation charge may apply due to committed logistics, staff, permits, flights, and supplier bookings.
-
Less than 15 days before trip start date: No refund may be available unless otherwise agreed in writing.
-
After trip commencement: No refund will be provided for unused services, early departure, voluntary withdrawal, missed services, illness, injury, late arrival, personal reasons, or failure to comply with trip requirements.
For expedition, mountaineering, restricted-area, peak climbing, luxury, private charter, helicopter, special permit, or custom trips, cancellation terms may be stricter because permits, logistics, staff, suppliers, and reservations may be non-refundable.
9. Refund Policy
Refund eligibility depends on the package, timing of cancellation, supplier terms, permit rules, and expenses already incurred. Refunds, where approved, will be processed after deducting:

Administrative charges;
-
Bank, card, transfer, payment gateway, and currency conversion fees;
-
Permit, visa support, conservation, national park, restricted area, or climbing fees already paid;
-
Hotel, flight, transport, guide, porter, crew, equipment, supplier, or logistics costs already committed or non-refundable;
-
Any costs incurred on behalf of the client.
Refunds may be made through the original payment method or another mutually agreed method. Refund processing times may vary depending on banks, payment gateways, and international transfer systems.
No refund will be given for services unused due to late arrival, early departure, illness, injury, weather, altitude issues, rescue or evacuation, personal choice, denial of entry, missing documents, breach of law, or failure to follow guide instructions.
10. Booking Changes by the Client
Requests to change travel dates, itinerary, accommodation, services, route, participants, or package details must be submitted in writing. We will make reasonable efforts to accommodate changes but cannot guarantee availability.
Additional charges may apply for:

Date changes;
-
Permit changes or re-issuance;
-
Flight changes or cancellation fees;
-
Hotel, transport, guide, porter, crew, or supplier changes;
-
Route changes;
-
Upgrade requests;
-
Additional services or extended stays.
Some bookings may be non-transferable or non-changeable, especially where permits, domestic flights, climbing documentation, restricted-area approvals, or supplier bookings have already been issued.
11. Changes, Postponement, or Cancellation by Ticino Treks
We reserve the right to modify, postpone, reroute, shorten, extend, or cancel any itinerary or service if necessary due to safety, weather, health, logistics, operational constraints, government restrictions, permit issues, supplier failure, force majeure, minimum group size requirements, or other circumstances beyond our reasonable control.
Where we make material changes before trip commencement, we may offer one or more of the following options where reasonably possible:

A revised itinerary;

Alternative travel dates;
-
A substitute package of comparable value;
-
A credit note for future travel;
-
A partial refund after deducting non-refundable costs already incurred.
We are not liable for incidental expenses or consequential losses such as visas, international flights, insurance, equipment purchases, vaccinations, accommodation outside the package, lost income, or other personal expenses.
12. Minimum Group Size and Fixed Departures
Some trips may require a minimum number of participants. If the minimum number is not reached, we may operate the trip with a surcharge, offer an alternative date, convert the trip to a private departure, or cancel the departure with applicable refund or credit options.
For fixed-departure trips, group composition, guide assignment, accommodation type, transport arrangements, and route may vary depending on operational needs.
13. Services Dependent on Third Parties
Many travel services depend on third-party providers, including airlines, hotels, lodges, teahouses, transport companies, helicopter companies, permit offices, government authorities, local municipalities, conservation bodies, restaurants, equipment suppliers, payment processors, banks, and emergency service providers.
Ticino Treks will use reasonable care in selecting and coordinating third-party services, but we do not own or control all third-party providers. We are not responsible for delays, cancellations, errors, accidents, omissions, service failures, misconduct, price changes, strikes, bankruptcy, or negligence of third-party providers, except where liability cannot be excluded by law.
Any third-party service may also be subject to its own terms and conditions.
14. Flights, Roads, and Transportation Delays
Mountain flights, domestic flights, helicopter services, road transport, and remote-area transportation in Nepal are highly dependent on weather, visibility, airport conditions, road conditions, traffic, landslides, strikes, government restrictions, and operational safety decisions.
Clients should allow buffer days before international departure, especially for Everest region, mountain flights, expeditions, peak climbing, remote treks, and monsoon or winter travel.
Additional costs caused by flight delays, cancellations, rerouting, road blockages, extra hotel nights, additional meals, vehicle changes, helicopter use, or itinerary changes are the client’s responsibility unless expressly included in the package.
15. Permits, Visas, Passports, and Entry Requirements
Clients are responsible for ensuring that they have valid passports, visas, travel permits, vaccinations, insurance, and entry documents required for Nepal and any other destination included in the itinerary.
Unless expressly stated, visa fees, international travel documents, passport services, vaccinations, and personal compliance costs are not included.
Ticino Treks may assist with trekking permits, climbing permits, restricted-area permits, conservation permits, national park permits, local permits, and other travel documentation where included in the package. However, issuance depends on government authorities, rules, eligibility, office closures, public holidays, documentation accuracy, and processing timelines.
We are not responsible for losses arising from denied visa, denied permit, missing documents, inaccurate information provided by the client, passport validity issues, entry denial, immigration decisions, or changes in government policy.
16. Health, Fitness, Medical Conditions, and Vaccinations
Clients must ensure that they are physically and medically fit for the selected trip. Before booking, clients should carefully review the trip difficulty, altitude, walking hours, climate, terrain, accommodation level, medical access, and emergency limitations.
You must inform us in writing before booking of any medical condition, allergy, disability, dietary restriction, medication, pregnancy, prior altitude sickness, heart condition, respiratory condition, mental health condition, recent surgery, or other matter that may affect participation or require special arrangements.
Failure to disclose relevant medical information may result in removal from the trip without refund if we reasonably believe continued participation creates safety or operational risks.
We may request medical clearance for high-altitude, expedition, peak climbing, or physically demanding trips. We do not provide medical advice. Clients should consult a qualified physician or travel medicine professional before travelling.
17. Travel Insurance
Comprehensive travel insurance is mandatory for trekking, expedition, mountaineering, peak climbing, high-altitude travel, and remote-area travel unless we expressly waive this requirement in writing.
Insurance should cover, as applicable:

Medical expenses;
-
Emergency evacuation;
-
Helicopter rescue;
-
High-altitude trekking or climbing;
-
Trip cancellation or interruption;
-
Personal accident;
-
Repatriation;
-
Lost baggage and personal belongings;
-
Adventure activities included in the itinerary.
Clients must provide insurance details before trip commencement if requested. If a client travels without adequate insurance, the client accepts full responsibility for all costs and risks, including rescue and evacuation expenses.
18. Emergency, Rescue, and Evacuation
In case of illness, injury, altitude sickness, accident, emergency, or safety risk, Ticino Treks, its guides, trip leaders, or representatives may take reasonable steps to protect the client, group, staff, and operation. This may include evacuation, route change, descent, medical consultation, helicopter rescue, hospital transfer, or termination of participation.
All emergency, medical, rescue, evacuation, helicopter, hospital, additional accommodation, transport, communication, and related expenses are the client’s responsibility unless covered by insurance or expressly included in the package.
We will make reasonable efforts to assist with insurance coordination, rescue communication, and emergency response, but we cannot guarantee rescue availability, helicopter availability, weather clearance, hospital capacity, road access, communication access, or third-party response times.
19. Accommodation, Meals, and Facilities
Accommodation standards vary by destination, package type, altitude, season, availability, and local infrastructure. Remote trekking regions may provide basic teahouses, lodges, shared rooms, shared toilets, limited hot showers, limited electricity, limited heating, and limited internet.
Meals may vary depending on region and availability. Clients with dietary requirements must inform us in advance. We will make reasonable efforts to accommodate dietary needs, but we cannot guarantee full availability in remote areas.
Single rooms, private bathrooms, luxury accommodation, special meals, hot showers, charging, Wi-Fi, bottled water, and other extras may not be included unless stated in the itinerary.
20. Guides, Porters, Crew, and Responsible Travel
We aim to operate responsibly and ethically with respect for our guides, porters, crew, local communities, environment, and cultural heritage.
Clients must treat staff, communities, fellow travellers, and service providers with respect. Abuse, harassment, discrimination, unsafe behaviour, intoxication, illegal drug use, violence, or refusal to follow safety instructions may result in removal from the trip without refund.
Clients must comply with weight limits for porter-carried luggage. Any excess baggage may require additional porter fees or alternative transport arrangements.
21. Client Conduct and Right to Remove from Trip
We may remove a client from a trip, refuse service, or terminate participation without refund if the client:

Breaks local laws or permit conditions;
-
Endangers themselves, staff, or other travellers;
-
Refuses to follow safety instructions;
-
Engages in abusive, discriminatory, threatening, or disruptive conduct;
-
Uses illegal substances or misuses alcohol;
-
Provides false or incomplete information;
-
Fails to carry required documents or insurance;
-
Causes repeated delays or operational disruption.
Any additional costs arising from removal, early departure, police involvement, medical issues, or alternative arrangements are the client’s responsibility.
22. Luggage, Equipment, and Personal Belongings
Clients are responsible for their personal belongings, equipment, documents, cash, electronic devices, valuables, and luggage. We are not responsible for loss, theft, damage, or delay of personal items unless caused by our proven negligence.
Clients must bring suitable clothing, footwear, sleeping bags, personal medication, gear, and equipment appropriate for the itinerary. We may provide recommended packing lists, but final responsibility rests with the client.
Rental equipment, if provided, must be returned in good condition. Clients may be charged for loss, damage, or late return.
23. Environmental and Cultural Responsibility
Clients must respect Nepal’s natural environment, cultural heritage, religious sites, local customs, wildlife, and communities. Clients must avoid littering, damaging trails, disturbing wildlife, removing cultural or natural objects, or behaving disrespectfully at sacred sites.
Clients must follow applicable conservation area, national park, municipality, restricted area, and local community rules.
24. Website Use
You may use our website only for lawful purposes. You must not:

Interfere with website security or functionality;

Attempt unauthorized access;
-
Upload malware, spam, or harmful code;
-
Copy or misuse our content for commercial purposes without permission;
-
Submit false, misleading, abusive, or unlawful content;

Use our website in a way that damages our reputation, systems, or business.
We may suspend or restrict access to our website if misuse is suspected.
25. Intellectual Property
All website content, itineraries, text, branding, logos, images, videos, designs, graphics, documents, and materials created by Ticino Treks are owned by or licensed to Ticino Treks unless otherwise stated.
Clients may not reproduce, distribute, modify, sell, publish, or commercially exploit our content without prior written permission.
26. Client Photos, Reviews, and Marketing Use
During trips, photos or videos may be taken by our staff, guides, or representatives. With your consent, we may use photos, videos, testimonials, reviews, or feedback for marketing, website, social media, brochures, or promotional purposes.
If you do not want your image, review, or testimonial used, please inform us in writing. We will respect reasonable requests to remove or avoid using identifiable client images in future marketing, subject to technical and practical limitations.
27. Complaints and Dispute Reporting During Trip
If a problem occurs during a trip, the client must inform the guide, trip leader, or Ticino Treks representative as soon as reasonably possible so that we can attempt to resolve it during the trip.
Complaints submitted only after the trip, where no opportunity was given to resolve the matter during the trip, may be more difficult to investigate or remedy.
Formal complaints should be submitted in writing within 14 days after trip completion.
28. Limitation of Liability
To the maximum extent permitted by law, Ticino Treks is not liable for indirect, incidental, special, punitive, or consequential losses, including loss of enjoyment, loss of profit, loss of opportunity, missed flights, visa costs, personal expenses, emotional distress, or costs not directly caused by our proven negligence.
Our total liability for any claim related to a booking will not exceed the amount paid by the client to Ticino Treks for the relevant service, except where such limitation is prohibited by applicable law.
Nothing in this document excludes liability where exclusion is not permitted by law.
29. Indemnity
You agree to indemnify and hold harmless Ticino Treks, its directors, officers, employees, guides, porters, agents, contractors, and partners from claims, losses, liabilities, damages, costs, and expenses arising from:

Your breach of these Terms;

Your violation of law or permit conditions;

Your negligence, misconduct, or unsafe behaviour;
-
False, incomplete, or misleading information provided by you;
-
Claims made by third parties because of your actions;

Costs incurred on your behalf during emergency, rescue, medical, evacuation, or alternative arrangements.
30. Force Majeure
Ticino Treks is not liable for failure or delay in performing obligations caused by events beyond our reasonable control, including but not limited to:

Weather, storms, snow, avalanches, landslides, floods, earthquakes, wildfire, epidemic, pandemic, disease outbreak, or natural disaster;

War, terrorism, civil unrest, strikes, protests, road blockages, political instability, border closure, or government restrictions;
-
Flight cancellation, transport disruption, fuel shortage, airport closure, supplier failure, communication failure, or infrastructure failure;
-
Changes in permits, laws, regulations, safety rules, or government orders;
-
Any other event that makes performance impossible, unsafe, illegal, or commercially impracticable.
In such cases, we may modify, postpone, reroute, or cancel services. Refunds or credits will be assessed after deducting non-refundable costs and expenses already incurred.
31. Governing Law and Jurisdiction
These Terms are governed by the laws of Nepal. Any dispute arising from or relating to these Terms, our services, website, or bookings shall first be addressed through good-faith negotiation.
If the dispute cannot be resolved amicably, it shall be subject to the competent courts or dispute resolution mechanisms of Nepal, unless otherwise required by applicable law.
32. Updates to Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, industry standards, or business practices. The updated version will be posted on our website with a revised “Last Updated” date.
Continued use of our website or services after updates means you accept the revised Terms.
